Terms of Service

1. Acceptance of terms

By accessing or using Splat3D (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of service

Splat3D converts photos, videos, and zip archives into interactive 3D scenes. The Service offers free and paid tiers with varying quality levels, processing speeds, and feature access. We may modify or discontinue the Service at any time, with reasonable notice for material changes.

3. Accounts

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these terms. You are responsible for safeguarding your account credentials and for all activity under your account.

4. Your content

You retain ownership of the photos, videos, and other content you upload, as well as the 3D models generated from them. By uploading content, you represent that you have the right to do so and that the content does not infringe any third-party rights.

By making a scene public, you grant us a limited license to display it in the gallery and on the site. You may revoke this license by making the scene private or deleting it.

5. Payments, credits, and refunds

The Service offers both free and paid tiers. Paid features use a credit system: each scene consumes credits based on the quality tier selected. Credits may be purchased individually or as part of a subscription plan.

• Purchased credits do not expire. They remain on your account until used or your account is deleted.
• Subscription credits (e.g., Pro plan) reset at the start of each billing cycle. Unused subscription credits do not roll over.
• Refunds: Credits consumed by successfully processed scenes are non-refundable. If a scene fails to process, affected credits are automatically returned to your account. If you believe you were charged in error, contact us within 30 days.
• Subscriptions: Pro subscriptions auto-renew at the end of each billing period. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Price changes:We may change pricing with 30 days' advance notice. Existing credit balances are not affected by price changes.
• Failed payments: If a payment fails, we will attempt to charge your payment method again. After three consecutive failures, your subscription may be downgraded to the free tier.

6. API access

The Service may provide API access via API keys. API keys are intended for your use only and must not be shared, published, or embedded in client-side code. You are responsible for all usage of your API keys. If a key is compromised, you must revoke it immediately from your dashboard. We reserve the right to rate-limit or revoke API access that harms the Service or other users.

7. Acceptable use

You agree not to:

• Upload content that is illegal, harmful, or violates others' rights
• Attempt to abuse, overload, or interfere with the Service
• Use automated tools to bulk-process or scrape content beyond authorized API usage
• Share, sell, or distribute your API keys
• Circumvent usage limits, quality restrictions, or billing controls

8. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent:

Your notice must include: (a) a description of the copyrighted work you claim has been infringed, (b) the URL or location of the infringing content on the Service, (c) your contact information, (d) a statement that you have a good-faith belief the use is unauthorized, and (e) a statement, under penalty of perjury, that the information is accurate and that you are the copyright holder or authorized to act on their behalf.

We will respond to valid takedown requests promptly and may terminate the accounts of repeat infringers.

9. Service availability

Processing runs on cloud GPUs and is subject to availability. We do not guarantee uptime, processing speed, or output quality. Large files or complex scenes may fail to process. Failed scenes will have their credits automatically refunded.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPLAT-3D OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Account termination

We may suspend or terminate accounts that violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 4 (ownership), 10 (warranty disclaimer), 11 (liability limitation), and 13 (governing law) survive termination. You may delete your account at any time by contacting legal@splat-3d.com.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in San Francisco County, California.

14. Changes to these terms

We may update these terms from time to time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance.
